Ask the Expert: Are non-physicians allowed to sit on a hearing panel?

The Health Care Quality Improvement Act allows the use of non-physicians on a hearing panel. However, any time a hospital contemplates the addition of a non-physician on the panel, it should consult state law. The bylaws can also address whether physicians employed by or contracted with the hospital will be eligible to serve. The bylaws should specify which individual(s) will appoint panel members (it is most commonly the CEO’s or president of the medical staff’s responsibility), and state whether there are any circumstances under which an individual can challenge the appointments made.
