Avoiding lawsuits resulting from credentialing decisions

 

There are two potential means to reduce the potential negative impact of a credentialing decision. First, for employed physicians, a hospital may consider including specific contractual remedies in employment contracts with physicians who allege some type of discriminatory action. Second, state law may provide a means by which a hospital could avoid litigation resulting from a patient's negligence claim. While litigation may be unavoidable in certain circumstances, hospitals should understand the resources they have at their disposal when confronted with a lawsuit from an aggrieved party.
