Credentialing & Peer Review Legal Insider, September 2014
Medical staffs across the country have found that establishing their own private treasury accounts funded by staff dues and application/reappointment fees has helped them maintain autonomy from hospital administration. This separation has become especially apparent when conflicts requiring legal counsel arise between the two parties.
Also, as medical staff leaders struggle to motivate physicians to fulfill their proctoring obligations, some have considered offering compensation to encourage those physicians to complete their evaluations. But before adopting this practice, a medical staff should ensure it has the proper policies in place to address any number of issues that may arise.
In this issue first case summary, the U.S. District Court of the Northern District of California dismissed a surgeon's lawsuit alleging that a hospital, its medical staff, its parent company, and certain individuals racially discriminated against him by limiting or suspending his privileges following the death of a patient.
In the second case summary, the U.S. District Court for the Northern District of Alabama, Southern Division, denied a motion to compel the University of Alabama Birmingham (UAB) to produce documents created by its institutional review board (IRB) in regard to a clinical research trial performed on premature infants with low birth weights.
