Florida court affirms MEC meeting's peer review protection despite bylaws violation
The Fifth District Appellate Court of Florida (the “Court”) recently upheld a trial court’s decision that a meeting of a hospital’s medical executive committee (MEC) was protected by the state’s peer review privilege. The Court also affirmed the trial court ruling that a related general medical staff meeting was not afforded the same protection. Note that this decision does not involve the issue of discovery.
