Louisiana appeals court finds physician’s documents partly protected by peer review

In a recent case, after a medical malpractice claim in which documents from the American Board of Orthopaedic Surgery (ABOS) were requested, the Fifth Circuit Louisiana Appeals Court (the “Court”) determined that some of the documents that were reviewed by the trial court were protected by peer review and not discoverable.
