Missouri court grants HCQIA immunity for revocation of clinical privileges

The United States District Court for the Eastern District of Missouri granted SSM Healthcare System's motion for summary judgment in an action brought by a medical doctor challenging a peer review decision to revoke his medical staff membership and clinical privileges at one of the defendant's hospitals, DePaul Health Center. The court's decision was based on a provision in the Healthcare Quality and Improvement Act (HCQIA) that grants immunity to hospitals from lawsuits for money damages for certain actions taken to discipline physicians.
