Tennessee appeals court affirms summary judgment in favor of hospital against surgeon?s claims
The Court of Appeals of Tennessee (Court) affirmed a lower court’s decision to grant summary judgment to a hospital after a surgeon brought a suit alleging breach of contract, defamation, and tortious interference with business relations following the hospital’s and surgeon’s negotiated restoration of the surgeon’s suspended privileges. The Court affirmed that because the surgeon waived his right to a fair hearing, he could not bring claims against the hospital.
