Court says HCQIA protects hospital and physician leaders
Citing performance issues, Humility of Mary Health Partners asked cardiothoracic surgeon George Georgopoulos, MD, to voluntarily refrain from performing coronary artery bypass surgeries and hired an independent physician to review several of his cases. Georgopoulos' independent reviewer reviewed the same cases, and based on that report, Georgopoulos refused to continue voluntarily refraining from performing the surgeries. The matter went to the medical executive committee (MEC), which voted to conduct a formal investigation into Georgopoulos' clinical competence. After the investigation, the MEC voted to monitor six more surgeries. Georgopoulos appealed the decision to a hearing panel, which upheld the decision to review the cases.
